Please read these Terms and Conditions carefully before accessing or using the Customz Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms.

1.2 Definitions

  • Application means the mobile application titled "CUSTOMZ – AI Car Customizer."
  • We, Us, or Our refers to the developer and operator of the Customz Application.
  • Service means, collectively, the Application, website, AI-powered tools, and any services offered by Us.
  • User Content means any images, photographs, text, or other content uploaded by You.
  • You means the individual using the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the Customz Privacy Policy. By accessing or using the Service, You agree to be bound by these Terms.

3. Eligibility

You represent and warrant that You are at least 13 years old. If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian.

4. Visualization Disclaimer (Important)

Customz is a creative visualization tool only.

Not Professional Advice:

The modifications shown in the app are artistic renderings generated by AI. They may not reflect the physical reality, safety, feasibility, or legality of actual vehicle modifications.

Fitment:

We do not guarantee that parts (rims, kits, spoilers) shown in the app will physically fit Your specific vehicle.

Legality:

We do not guarantee that modifications generated by the AI (e.g., window tint darkness, plate placement, ride height) are street-legal in Your jurisdiction.

Watermarks:

The Application does not remove third-party watermarks; any 'clean export' feature refers only to exporting without CUSTOMZ branding overlays.

Professional Consultation:

You should always consult a professional mechanic or body shop before attempting any physical modifications based on images generated by the Service.

5. User Content; License Grant

By submitting User Content, You represent that You own or have rights to it. You grant Us a worldwide, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, analyze, process, modify, publish, and create derivative works from the User Content to operate and improve the Service, including training AI models.

You agree not to upload unlawful, harmful, or offensive content.

You agree not to upload images containing identifiable information of others (such as license plates of vehicles you do not own) without lawful consent.

6. Intellectual Property

Our Rights:

All rights in the Service (excluding User Content) are owned exclusively by Us.

Trademarks:

All vehicle manufacturer names, brand names, trademarks, and registered trademarks mentioned or depicted in the Service are property of their respective owners. Their use is for descriptive or compatibility purposes only and does not imply any affiliation with or endorsement by the trademark holders.

7. Subscription and Purchases

If subscriptions are offered in the Application, then on iOS they are offered only via Apple In-App Purchase (StoreKit) and are managed in your Apple ID subscription settings. We do not offer iOS subscriptions via external payment methods or links inside the iOS app. Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.

8. Limitation of Liability

To the maximum extent allowed by law, Our total liability shall not exceed the greater of:

  • The amount You paid in the preceding 12 months, or
  • One hundred dollars (USD $100)

We are not liable for indirect, incidental, or consequential damages, including loss of profits or data, or damages resulting from physical modifications made to vehicles based on App visualizations.

9. Governing Law

These Terms are governed by the laws of Ontario, Canada. You agree to jurisdiction in the courts of Ontario, Canada.
